Penalties for building houses under a plan?

* Fines for building houses in violation of the planning:

Clause 9, Article 16 of Decree 16/2022/ND-CP stipulates the level of sanction for construction in contravention of the approved construction and urban planning as follows:

- A fine of between VND 80-100 million for construction of separate houses (villas, townhouses, independent houses).

- From 100 to 120 million VND for building separate houses in conservation zones, historical-cultural relics or other construction works.

- From VND 160 to VND 180 million shall be imposed for construction of works requiring construction investment feasibility study reports or construction investment economic-technical reports.

* Fines for recidivism:

Clause 13, Article 16 of Decree No. 16/2022/ND-CP stipulates the level of sanction for  construction in contravention of construction plannings or urban plannings, which is administratively sanctioned but being done again is not subject to a criminal responsibility  as follows:

- A fine of between VND 120 and 140 million for building separate houses;

- From 140 to 160 million VND for building separate houses in conservation zones, historical-cultural relics or other construction works;

- A fine of between VND 950 million and VND 01 billion shall be imposed for construction of works requiring construction investment feasibility study reports or construction investment economic-technical reports.

If being detected and made a record, the construction will have to be stopped.
