How is the authorization to verify the conditions for judgment execution between the bailiff's Offices?
- The Bailiff's Office may authorize part or all of the work under the service contract to verify the conditions for judgment enforcement for another Attorney's Office to perform, if the requester agrees.
- The authorization between the bailiff's Offices must be in writing and contain the following contents: Information of the bailiff'l's Offices; information about the person requesting verification, verification content according to the signed service contract; content of authorization, contents of implementation (if any), content of continued verification, authorized remuneration and other agreements (if any)
The authorization must be notified in writing to the district-level People's Procuracy where the attorney's office authorizes, the attorney's office receives the authorization to locate in order to carry out the supervision in accordance with the law.
- The bailiffs Office receives authorization to carry out the verification in accordance with the provisions of Decree No. 08/2020/ND-CP and the law on civil judgment enforcement.
