From January 10, 2022, amending regulations on appraisal fees for Red Book issuance

On November 26, 2021, the Ministry of Finance issued Circular 106/2021/TT-BTC amending and supplementing a number of articles of Circular 85/2019/TT-BTC on fees and charges under the decision of the People's Councils of provinces and centrally run cities.

 Specifically, Circular 106/2021/TT-BTC amending and supplementing Circular 85/2019/TT-BTC on fees for appraisal of dossiers for grant of land use right certificates is as follows:

Fees for appraisal of dossiers for grant of land use right certificates are collected for the examination of dossiers, necessary and sufficient conditions to ensure the issuance of certificates of land use rights and house ownership and land-attached assets (including first-time, new, renewed, re-issued certificates and change certificates into issued certificates) in accordance with the law.

Based on the size of the land plot, the complexity of each type of application, the purpose of land use and the specific conditions of the locality to determine the fee rate for each case.Ảnh minh họa

Current regulations in Circular 85/2019/TT-BTC only prescribe “issuance” of certificates, while “Circular 106/2021” divides into “first-time issuance” and “new issuance”.

In addition, the regulations on registration fees for secured transactions are amended as follows:

Security transaction registration fee (security interest registration fee) is the fee collected when certifying the registration of security interests with land use rights and land-attached assets at state agencies has the authority to offset costs for the performance of jobs, registration services of security interests with land use rights and assets attached to land and to cover expenses for toll collection activities.

Based on specific local conditions to stipulate the fee rate according to the registration dossier or the number of certificates of land use rights, ownership of houses and other land-attached assets, or the number of land parcels and assets. property attached to land is certified on a certificate in the application for registration of security interest or other registration cases  appropriately".

Meanwhile, Circular 85/2019/TT-BTC explains the security transaction registration fee as receipts by land use rights and land-attached assets at competent state agencies.

The regulation of security transaction registration fee is also based on the number of certificates of land use rights, ownership of houses and other land-attached assets (previously regulated cases of registration, parcel of land).

Circular 106/2021/TT-BTC takes effect from January 10, 2022.
