What is the current penalty for robbery?

In many cases, due to the resistance of the victim or for many other reasons, the subject of the robbery cannot get the property. If the subject has used force to rob the property but failed, will he be criminally prosecuted?

Clause 1, Article 168 of the Penal Code 2015 stipulates the penalties for property robbery as follows:

Main penalties:

- Frame 01

A prison term of 3 - 10 years if using force, threatening to use force immediately or committing other acts to make the attacked person unable to resist in order to appropriate property.

- Frame 02:

A prison term of 07 - 15 years if the crime is committed in one of the following cases:

+ Organized;

+ Be of a professional nature;

+ Inflicting injury or causing harm to the health of others with an injury rate of 11% -30%;

+ Using weapons, means or other dangerous tricks;

+ Appropriating property valued between 50 and under 200 million VND;

+ Committing the crime against a person under 16 years old, a woman who is known to be pregnant, an elderly person or a person incapable of self-defense;

+ Causing adverse effects on social security, order and safety;

+ Dangerous recidivism.

- Frame 03:

A prison term of 12 - 20 years if the crime is committed in one of the following cases:

+ Appropriating property valued between 200 and under 500 million VND;

+ Inflicting injury or causing harm to the health of others with an injury rate of between 31%- 60%;

+ Taking advantage of natural disasters and epidemics.

- Frame 04:

Imprisonment of 18 - 20 years or life imprisonment if the crime is committed in one of the following cases:

+ Appropriating property worth 500 million VND or more;

+ Inflicting injury or causing harm to the health of 1 person with an injury rate of 61% or higher or causing injury or causing harm to the health of 2 or more people with an injury rate of 31% or more for each person;

+ Causing death;

+ Taking advantage of war and emergency situations.

In addition, the person who prepares to commit the crime can be sentenced to between 1 and 5 years in prison

Additional penalties

- A fine of from 10 to 100 million VND;

- Impose probation, ban from residence for 1 - 5 years or confiscate part or all of property.
