Lawyer Luu Binh Nhuong: "Phan Anh, Thuy Tien or Thai Thuy Linh are all groping when doing charity"

In order to reduce the errors and mistakes of individuals to make charity work publicly and transparently according to the law, Dai Doan Ket newspaper recently held a discussion with the topic "Is it right for individuals to do charity?". The seminar was attended by Dr. Luu Binh Nhuong, former Deputy Head of the National Assembly's Civil Volunteers Committee (XV session); Representative from the City Bar Association. Hanoi, Colonel - Law Doctor Le Ngoc Khanh, and some artists participated in charity activities. We cannot do charity like Phan Anh, Thai Thuy Linh or Thuy Tien.

Speaking at the seminar, former deputy head of the National Assembly's Civil Volunteers Committee (term XV), Lawyer Luu Binh Nhuong said that now there are regulations related to charity work, such as Decree 64. In addition Decree 93 also stipulates that organizations can mobilize social charity funds. However, there is still a lack of regulations on individuals doing charity.

According to him, charity depends on heart and virtue . He or the National Assembly deputies do charity based on personal prestige to mobilize businesses, social organizations, and sponsors.

If the business helps, the enterprise will contact the Fatherland Front or the local delegation to build houses of gratitude; build bridges, roads and schools... but he or the National Assembly deputies never hold money.

"I do charity in my own way, because we are people who understand the law, we can't do it like Phan Anh, Thai Thuy Linh or Thuy Tien. I still have to do charity work in term of money supporting which means i dont hold any money," said Lawyer Luu Binh Nhuong.

Sharing his views on individuals doing charity, he said that individuals should not be banned from doing charity. Besides, it's also good to rely on the reputation of a celebrity. However, it is important to have a legal mechanism to control it.

The example stipulates who is qualified to do it and how. At the same time, there must be a legal basis for handling, so that philanthropists can stick to it, not do whatever they like.

"Mr. Phan Anh, Ms. Thuy Tien or Ms. Thai Thuy Linh are all groping in the past. We have to socialize so that the whole society can do charity," said Law Doctor Luu Binh Pyongyang.

"When Thuy Tien broke out about charity, I said to the National Assembly lobby, but it seems that Thuy Tien did not understand. Thuy Tien better coordinate with organizations to reduce the risks," he added.

People will not accept that the storm has passed but not having money support.

Regarding the statement, a representative from the City Bar Association in Hanoi, Colonel - Dr. in laws Law Le Ngoc Khanh agreed with the guests that it is necessary to be transparent about money used for charity. However, in his view, statements alone are not enough.

Explaining this view, Dr.Le Ngoc Khanh said that the bank statement only knows the amount of money transferred into and withdrawn from the bank account. However, he posed the question, how will the money be controlled once it is out of the bank?

"An individual mobilizes to raise 100 billion, withdraws 100 billion from the bank, but after withdrawing, what to spend it on, who to spend it for, who knows? books, it is necessary to have a full receipt, so after withdrawing money from the bank, who should it be spent for, what should be very clear?", Mr. Khanh gave an example.

Experts say that it is nice for those who do charity, and the law must allow  individuals to do. However, who do wrong must be responsible before the law.

"However, at present, there are very few sanctions on charity work. Therefore, I still want to re-emphasize the issue that is: There should be a legal basis to regulate personal charity work," Dr. Nhuong said.

When asked about sanctions for the act of calling for donations but keeping money for a long time, typically in the case of Hoai Linh, Mr. Nhuong frankly said that this completely depends on the motive and purpose.

Mr. Nhuong analyzed: "In Hoai Linh's case, we must consider his purpose. Campaigning for the purpose of storms and floods will only be solved in the situation of storms and floods. After that, he still holds it. then people don't accept it. Must be disbursed right away, how long does it take to keep the interest now, where even the husband can't add interest. Thus, the purpose of charity is very important, it must be determined when did the calling happen?"
