Components of the application file for registration of land changes:

The profile composition includes the following:

  • An application for registration of changes in land and land-attached assets, made according to Form No. 09/DK;
  • The original of the issued Certificate;
  • A drawing of a diagram of a house or a construction work associated with land use rights in case the land user wants to change the certificate of land use right.
  • One of the documents related to change: donation contract, transfer contract, written declaration of inheritance, written agreement on division of inheritance, written agreement on common property or husband and wife's own.
  • Power of Attorney (if the applicant is authorized).
  • Personal documents such as citizen identification, identity card, household registration book, certificate of marital status and other documents related to the registration of changes.
  • The latest non-agricultural tax return, receipt of the latest non-agricultural tax collection and other documents at the request of the application-handling agency.

Procedure for submitting application for registration of land change.

Step 1: Submit an application for registration of changes at the district and provincial land registration office.

  • Person responsible for application submission: Land user submits 01 set of application
  • Place of application submission: According to the provisions of Clause 2, Article 60 of Decree No. 43/2014/ND-CP, the person responsible for submitting the application shall submit the application to the application-receiving agency, specifically as follows:
  • Land registration office;
  • Where there is no land registration office, the provincial land use right registration office shall receive dossiers for organizations, religious organisations, Vietnamese people residing abroad implementing investment projects or foreign organizations, foreign individuals, foreign-invested enterprises; The district-level land use right registration office receives dossiers for households, individuals, residential communities, and overseas Vietnamese who are entitled to own houses associated with residential land use rights in Vietnam;
  • In case households, individuals or communities wish to submit dossiers at the commune-level People's Committees, the commune-level People's Committees of the localities where the land is located shall receive the dossiers and return the results. In case of registration of changes in land, properties attached to land; for renewal or re-grant of a Certificate, within 3 working days from the date of receipt of a complete dossier, the commune-level People's Committee must transfer the dossier to the land registration office.

Step 2: The land registration office or the branch of the land registration office is responsible for checking the dossier, if the dossier is not complete, the applicant shall be requested to supplement the application for completion. If enough, write a receipt for the application and schedule a date to return the results of the application.

Step 3: The land registration office, or the branch of the land registration office, shall carry out the following procedures for registration of land changes:

  • Send cadastral information to tax authorities to determine and notify collection of payable financial obligations, financial obligations include:
  • Pay registration fees when registering land, houses and other land-attached assets;
  • Pay personal income tax in case the seller has to pay tax.
  • Pay the fee for issuance of certificates of land use rights, ownership of houses and other land-attached assets.
  • Land registration office, branch of land registration office confirm to update information on the issued Certificate.

Step 4: Returning the application result

The applicant receives the results directly at the branch of the land registration office according to the time specified in the application receipt. 

Expenses incurred in case of land change registration:

  • The registration of earthquakes is done for many cases, each case will have different costs incurred. However, basically, the registration of land changes will have the following main costs:
  • Personal income tax: 2% based on personal income (usually the contract price);
  • Registration fee: 0.5% is calculated based on the comparison between the selling price stated in the contract with the price prescribed by the state based on the specific land price of the land price list. The highest price will applied;
  • And some other costs incurred such as: notary fees, application appraisal fees, cadastral measurement fees, variable registration fees...
