1. Preparation of logo copyright registration documents
After classifying and choosing a form of protection, the owner needs to prepare a logo copyright registration file according to the content of the file composition as guided in the law.
2. Submit an application for registration at the Copyright Office or the National Office of Intellectual Property
After fully preparing the application, the owner can directly or authorize another organization/individual to submit the registration dossier at:
- Register the logo at the Copyright Office in the form of copyright registration at the address Hanoi: No. 33 Alley 294/2 Kim Ma, Ba Dinh District, Hanoi City; Da Nang: No. 01 An Nhon 7, An Hai Bac ward, Son Tra district, Da Nang city; Ho Chi Minh City: No. 170 Nguyen Dinh Chieu Street, District 3, Ho Chi Minh City.
- Register the logo at the National Office of Intellectual Property in the form of a trademark at the address of Hanoi: 386 Nguyen Trai, Thanh Xuan Trung ward, Thanh Xuan District, Hanoi City; Da Nang: 3rd floor, 135 Minh Mang street, Khue My ward, Ngu Hanh Son district, Da Nang city; Ho Chi Minh City: 7th floor, Ha Phan building, number 17-19 Ton That Tung, Pham Ngu Lao ward, district 1, city. 3. Follow up the logo copyright application after submission
After the application is submitted, the application will be reviewed by the appraisal agency before accepting or refusing to grant the logo registration certificate to the owner.
4. Receipt of logo registration certificate
In case when verifying the application file, the registration file makes a request in accordance with the provisions of the Intellectual Property Law, the registration agency will issue a certificate of logo copyright registration to the owner.
- Time for logo copyright registration at the Copyright Office: Regarding the time for granting a copyright certificate for a logo, according to the provisions of Article 52 of the Intellectual Property Law, it is 15 days. However, the actual registration time is often extended and in the period from 20-30 days (from the date of valid application).
- Time to register a logo in the form of Trademark registration at the National Office of Intellectual Property of Vietnam: The time to register a logo in the form of a trademark will be divided into several stages in the process of doing work and is calculated as follows: :
- Filing documents and submit application: 1-2 days
- Formal examination of the application: 1-2 months from the date of application
- Posting in the Industrial Property Official Gazette about the application status: 1 month after formality examination
- Substantive examination of the application: 9-12 months
- Issuing a notice of issuance of registration certificate: 1-2 months
