Fine upto VND 70 million for advertisement of tobacco and alcohol of over 15 degrees

This is the content specified in Decree 38/2021/ND-CP stipulating penalties for administrative violations in the field of culture and advertising.

Specifically, in Clause 1, Article 33 Decree 38/2021/ND-CP, a fine of between VND 50 and 70 million is imposed for one of the following acts:

- Tobacco advertising;

- Advertisement of alcohol of 15 degrees or more;

- Advertising breast milk substitutes for children under 24 months old; complementary foods for children under 6 months old; baby bottles and pacifier for babies;

- Advertising prescription drugs; over-the-counter drugs that are recommended by the competent authority to limit their use or use under the supervision of a physician; the drug is no longer valid for circulation registration;

- Advertise other products, goods and services that are prohibited from advertising.

Currently, according to Clause 1, Article 50 Decree 158/2013/ND-CP the above violations are subject to a fine of between VND 40 and 50 million.

Thus, from June 1, 2021, a fine of up to VND 70 million will be imposed for advertising tobacco and alcohol with an alcohol content of 15 degrees or more, ... (a sharp increase compared to the current maximum fine level which is 50 million Vietnamese dong).

Note: The above sanction applies to individuals, in case organizations commit similar violations, the fine will be doubled.

Decree 38/2021/ND-CP  takes effect from June 1, 2021.
