Penalties for violations of social distancing regulations

Facing the complicated development of the Covid-19 epidemic, many localities across the country have implemented social distancing to prevent and control the spread of disease in the community. Social distancing is an urgent measure to prevent and control the COVID-19 that the State sets out in a complicated and dangerous epidemic situation.

To deter and prevent violations of epidemic prevention and control, Article 12 of Decree 117/2020/ND-CP also stipulates other fines such as:

- A fine of between VND 01 - 03 million for one of the following acts:

+ Failing to take personal protection measures for participants in the fight against epidemics and people at risk of disease according to the guidance of health authorities;

+ Failure to report to the People's Committee or preventive medicine agency in the locality about the case of epidemic disease as prescribed by law.

- A fine of between VND 5 - 10 million for one of the following acts:

+ Concealing his/her own or other person's illness when suffering from an infectious disease that has been declared epidemic;

+ Failing to take or refuse to take measures to clean, disinfect and disinfect in epidemic areas;

+ Not participating in the fight against the epidemic according to the mobilization decision of the Anti-epidemic Steering Committee;

 

- A fine of from 20 to 30 million dong for one of the following acts:

+ Failing to implement the decision on inspection, supervision and medical treatment before entering and leaving the epidemic area of ​​group A;

+ Take out of the epidemic area articles, animals, plants, food and other goods capable of transmitting the disease...

- A fine of between VND 30 - 40 million for one of the following acts:

+ Failing to comply with the request for medical examination and treatment of means of transport before leaving the epidemic area in an epidemic emergency; + Failing to implement the decision to ban mass gatherings in areas where a state of emergency has been declared;

+ Bringing people and vehicles that are not on duty into the outbreak in an area where a state of emergency has been declared…

Not only being administratively sanctioned, in case of violating regulations on Covid-19 epidemic prevention and control but also infecting others, the executor can also be prosecuted for penal liability for the crime of spreading the disease according to Article 240 of the Penal Code 2015 with a penalty of up to 12 years in prison.
