Guidelines for tender documents for consulting services under Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP)

This Circular details the preparation of bidding documents for consulting services for bidding packages under the scope of regulation of:

- Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP Agreement);

- Free Trade Agreement between Vietnam and the United Kingdom of Great Britain and Northern Ireland (UKVFTA Agreement);

- The Free Trade Agreement between the Socialist Republic of Vietnam and the European Union (EVFTA Agreement) is open to public bidding.

In which, the preparation, appraisal and approval of bidding documents shall be carried out as follows:

- Based on the scale and nature of each bidding package, the bid solicitor shall make appropriate requirements to ensure competition, transparency, fairness and economic efficiency. Bidding documents must contain all necessary information for contractors to prepare bids;

- The party calling for tenders must not introduce conditions that limit the participation of contractors or create advantages for one or several bidders, causing unfair competition;

- Does not require a contractor who has signed one or more contracts with a procuring agency of a particular country or territory or that the contractor has experience in providing services in the territory of that country. such country or territory as the criterion for disqualification of the bidder;

- In case of modification of the provisions stated in the Bidding Documents Form, the organization or individual that prepares, appraises and approves the bidding dossier must make the corrections more strictly than those specified in the Bidding Documents Template and not inconsistent with the provisions of the Agreements.

The written request for approval of the bidding documents must clearly state the content of the modification compared with the provisions in the form of the bidding dossier and the reasons for the modification for the investor to consider and decide.

This Circular takes effect from November 20, 2022.
