A gift agreement (Donation agreement)

1. House ownership certificate and land use right certificate. In case of donation a part of real estate, we must have these documents: Official dispatch from Land registration office or  Environmental resources department,  Phòng Tài nguyên - Môi trường, Land parcel- record, house map

2. Identity card or passport of the giver (wife and husband)

3. Family register of the giver (wife and husband)

4. Certificate of marital relationship of the giver.

* In case that the giver is a person, these documents needed:

1. Certificate of marital status (If havent married yet)

2. Judgment of divorce + certificate of marital status (if divorced)

3. Death certificate of wife or husband + Certificate of marital status (if wife or husband dead before having the property)

4. Documents that prove the separate property in cases of donated property, inherited property or private property as agreement or judgment on division of property ( gift agreement, declaration of inheritance acceptance, declaration of inheritance refusal, judgment on division of property)

5. Authorization contract of donation (if having)

6. Document that proves the relationship between the giver and the receiver (if having) such as certificate of birth.

Documents needed from the giver and receiver:

1. Identity card or passport

2. Family register (if the giver or the receiver is married couple, there must be wife or husband having permanent residency in Ha Noi)

3. Certificate of marital relationship (if the giver or receiver is married couple)

4. Documents that prove the relationship with the giver or receiver (Certificate of birth/ Resume/ family record) (if have)

5. Notary service request form + declaration (form at notary office)
