Notarization procedures of sale and purchase moveable property

Documents need to be provided by buyer:

* In case that the seller of moveble property is a person, there are below documents needed:

1. Certificate of marital status (if single from the past to now)

2. Judgment of divorce + certificate of marital status (if get a divorce).

3. Death certificates of wife or husband + Certificate of marital status (if wife or husband died before have the property).

4. Documents prove that the properties are given, inherited or agreed; judgment of property division (donation contract, declaration of inheritance, agreement on property division, judgment of property division)

5. Authorization agreement (if having)

Documents need to be provided by buyer

* In case that the buyer is juridical person, there are below documents needed:

1. Establishment decision/ Business registration certificate/ Certificate of investment

2. Identity card or passport of legal representative/ representative signing the contract.

3. Meeting minutes of BOD/ BOM (in case of joint stock company; limited liability company with 2 members and more)

4. Power of attorney (in case of authorization on signing contract or transaction)

5. Notary service request form + declaration (follow the form issued by the notery office)

* In case that the buyer is a person, there are below documents needed:

1. Identity card or passport of buyer

2. Family register of Purchaser whose's property is moveable asset: notary office will guide the process and procedures in some cases:

 - Moveable asset belonging to family

-  Land is not considered as a long- term asset

-  The purchaser is under 18

- Having foreign element

- Regarding to inheritance
