People's Court periodically reallocates civil servants

Civil servants and public employees of the People's Court work in field of financial, budget and property management of the State, capital construction investment, and project management; staff organization; inspect, examine and settle complaints and denunciations; emulation and reward; education and training or professional departments that directly contact and handle the work of agencies, organizations, units and individuals must periodically change their working positions in order to prevent corruption and negativity.

The Supreme People's Court has promulgated regulations on reallocation of employees in which specific provisions on the subjects, principles of conversion, competence to change, methods and deadlines are specified. periodically change working positions in accordance with the Law on Anti-corruption 2018 and other relevant laws.

This regulation applies to civil servants and public employees who do not hold leadership and management positions who are working at the People's Courts at all levels, holding positions in the fields of financial and budgetary management, assets of the State, investment in capital construction, management of projects; staff organization; inspect, examine and settle complaints and denunciations; emulation and reward; education and training or professional departments directly contact and handle the work of agencies, organizations, units and individuals.

The rotation of civil servants holding leadership and management positions shall comply with regulations on cadre rotation.

The change of working positions is carried out periodically and regularly, and applies to civil servants and public employees who are assigned to working positions in the fields or working divisions specified.

The period of periodic change of working position is from full 3 years to 5 years depending on the characteristics of each job and field.

For positions that periodically have to change jobs with specific professional requirements compared to other positions, stability is required, combined with specialized training of specialists in the field of work and civil servants. If the officers working in this position have the capacity, prestige, and successfully complete the assigned tasks each year, the unit leader may decide the period of periodic change of positions for more than 5 years.

Employee reallocation method

The draft plan for the periodical change of working positions must be approved by the collective leadership and committees of the unit; be publicly announced within 15 days for all civil servants, public employees and employees in the unit to contribute comments; After gathering comments, the leadership team and the committees discussed and approved and reported to the leader directly in charge of the unit. Reallocation for civil servantsshall be effected by decisions on mobilization, arrangement and assignment of tasks for civil servants and public employees according to the provisions of law and of the People's Court.

The Decision also specifies the method of carrying out the change of working positions as follows: Transfer of working positions with the same expertise and profession from one department to another in the agency or unit; between the fields and areas assigned to monitor and manage, or between agencies and units within the scope of management under the units of the Supreme People's Court, the Supreme People's Court, the Supreme People's Court. People's Courts of provinces and centrally run cities, People's Courts of districts, towns and provincial cities.

Reallocation for civil servants and public employees shall be publicly notified to civil servants and public employees 30 days in advance, since the date of commencement of the change of working positions.

The Decision also specifies cases where the change of working position has not yet been carried out, including:

1- Persons being examined and disciplined;

2- Persons being examined, verified, inspected, investigated, prosecuted or tried;

3- Person being treated for a serious illness certified by a competent health agency; people who are going to concentrated school for 12 months or more, people who are being seconded;

4- Women who are pregnant or nursing a child under 36 months old; men who are raising children under 36 months old due to the death of their wives or in other objective cases, except for cases according to the wishes of civil servants or public employees.
