Detoxification establishment must arrange a separate area for people aged 12-18 years old

22/04/2021

This is one of the highlights in the provisions of the Law on Drug Prevention and Control No. 73/2021/QH14 passed by the National Assembly on March 30, 2021.

Accordingly, public drug addiction treatment establishments must arrange 06 separate areas, including: Temporary accommodation for persons proposed to determine the status of drug addiction treatment, who are preparing application dossiers for detoxification measures; Compulsory drug detoxication zone; Voluntary drug detoxication zone; Detoxification areas for people suffering from group A and group B infectious diseases; Detention centers for people who cause disorderly behavior, violate rules, etc. In particular, detoxification establishments must have separate detoxification zones for people from full 12 years old to under 18 years old.

On the other hand, the Law also clearly stipulates that drug addicts from full 12 years old to under 18 years old who do not register, do not perform or voluntarily terminate voluntary drug detoxification; illegal use of narcotics during voluntary detoxification; or drug addicts with opiate substances who do not register, do not perform or voluntarily terminate addiction treatment with alternative drugs, will be sent to compulsory detoxification establishments.

In addition, the Law also specifically stipulates cases of drug testing in the body, previously the Law on Drug Prevention and Control in 2000 and the 2008 Amendment Law did not. Specifically, people who are found to be illegally using narcotics; a person whom a competent authority or person has grounds to believe has an illegal use of narcotics; Illegal users of narcotics under management... will be tested for drugs in their bodies.

The law took effect on January 1, 2022.
