Công trình, nhà ở riêng lẻ không có giấy phép xây dựng trước khi khởi công xây dựng sẽ bị xử phạt vi phạm hành chính, trường hợp có đủ điều kiện cấp giấy phép xây dựng sẽ được cấp giấy phép nếu chủ đầu tư chuẩn bị đầy đủ hồ sơ và nộp hồ sơ đề nghị cấp theo đúng thời hạn quy định. Clause 1, Article 81 of Decree 16/2022/ND-CP specifically stipulates:

    1.  Competent persons are responsible for making records of administrative violations and request organizations and individuals to stop the construction. Within 90 days for construction investment projects, 30 days for separate houses from the date of issuance of the decision on sanctioning of administrative violations, organizations and individuals committing violations must complete the application form for a construction permit to a competent authority…”.

Even while the construction is in progress, if it is eligible to be granted a construction permit, it must temporarily stop the construction and be granted a construction permit.
