What is the penalty for marrying an underage person?

Marrying an underage person is called the child marriage, which is one of the prohibited acts according to Point b, Clause 2, Article 5 of the Law on Marriage and Family.

Child marriage is one of the backward habits that is being campaigned for elimination according to the appendix issued together with Decree 126/2014/ND-CP.

The act of marrying an underage person will be subject to a fine of between VND 3 million and VND 5 million if they continue to have an illegal husband and wife relationship with an underage person even though the court has issued an effective judgment or decision to end this situation according to Article 58 of Decree 82/2020/ND-CP.

For those who organize marriages for underage people to get married, they will be administratively sanctioned even examined for penal liability in more severe cases as follows:

- Administrative fine: From 01 - 03 million VND.

- Take criminal responsibility for the crime of organizing child marriage  based on Article 183 of the Penal Code: A fine of between VND 10 million and VND 30 million or non-custodial reform for up to two years if they have been administratively sanctioned but continue to commit the violations.

Thus, if the underage person gets married, the maximum administrative fine is 5 million VND, and if the person organizes an early marriage for another person, he/she may be subjected to a non-custodial reform of up to 2 years.
