5 requirements when participating in an online trial

On December 15, 2021, the Supreme People's Court - Supreme People's Procuracy - Ministry of Public Security - Ministry of Defense - Ministry of Justice issued Joint Circular 05/2021/TTLT-TANDTC-VKSNDTC-BCA -BQP-BTP on organizing an online trial.

Specifically, in Article 11 of the Joint Circular, 05 requirements when participating in an online court hearing are as follows:

  • Comply with courtroom rules.
  • Always leave the electronic device open with the camera and microphone on; only speak when being asked to .
  • Other noises must not be created while the electronic device is on, which may interfere with the hearing.
  • Court participants must wear formally; do not get up or leave during the trial without the permission of the presiding judge; do not take pictures, record audio, record video, record video with sound, distribute documents or distribute account information to log in to the online adjudication system, or live stream the court hearing in cyberspace.
  • The involved parties, victims, defense counsels, defenders of the litigants' legitimate rights and interests, and victims participating in the online court hearing must present one of the identification papers (such as dentity card, chip- based ID card, passport, lawyer card, legal assistant card) for reference.

In case the involved parties authorize an attorney in the proceedings, the authorized person must present a power of attorney.

This Joint Circular takes effect from February 1, 2022.
