A fine of up to VND 50 million if publishing with conviction without a statement of accusation by Law court

The regulation of the fine for administrative violations in journalism and publishing activities has been newly issued by the Government in Decree 119/2020 / ND-CP on October 7, 2020.

To be specific, at Article 8, clause 4 in Decree has point out a fine from 30 million VND to 50 million VND with one of below cases:

a) Specifically discribe terrifying violations, accidents in news, article and photos;

b) Condemme a crime without any accusations by the Law court which are legally valid;

c) Post or spread the new about mysterious tales which make the people worried, badly impact on health, public order and safety;

d) Post or spread the news about relatives, relationships of people involved in negative crimes or cases without any proofs that prove those people or relationships relating to the crimes or cases; or without any conclusions from the authorized state agencies;

đ) Introduce, advertise, put a link that reaches to websites having illegal content;

e) Execute priciples or purposes that are not written in media license, domestic television programme service licence that cause little damage.

As such, from the first of December, 2020, a fine from 30 million to 50 million VND willl be charged if any organizations posts or spread an unofficial news on newspaper, news or special issues that is not in any accusation from the Law court that is not legally valid;

(Currently, Decree No 159/2013/NĐ-CP about the regulations to penalize administrative violations in publishing activities  doesnt include regulation about this behavior).

Decree 119/2020/NĐ-CP will be valid by the first of December, 2020.

This Decree will replace Decree No 159/2013/NĐ-CP dated the 12th of November, 2013 of the Government about taking the pelnaty for administrative violation in media, publishing activities; except the case prediscribed in Article 43 of this Decree.
